Terms of Service

These Terms of Service (Terms) govern your access to and use of CheckDataNow (the Platform), operated by Funnel Freaks (Funnel Freaks, Company, we, our, or us). By accessing or using the Platform, you agree to be bound by these Terms.

1. The Service

CheckDataNow is a monitoring and incident‑workflow platform that connects to Google Analytics 4 (GA4) via user authorization to retrieve aggregated reporting data, detect anomalies, and generate operational alerts. The Platform does not modify your analytics configuration or write data back to GA4.

2. Eligibility and Authority

You must be at least 18 years old to use the Platform. You represent and warrant that you have the authority to connect any GA4 property you link to CheckDataNow and that you will use the Platform for lawful business purposes and in compliance with all applicable laws.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us promptly at dev@funnelfreaks.co if you believe your account has been compromised or used without your authorization.

4. Customer Data and Privacy

You retain ownership of your GA4 data and any business data you connect. We process data as described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our data practices as described in the Privacy Policy.

5. Acceptable Use

You agree not to:

• Attempt to gain unauthorized access to the Platform or related systems
• Reverse engineer, decompile, or otherwise attempt to extract source code except where permitted by law
• Use the Platform to monitor properties you do not have permission or lawful authority to access
• Interfere with or disrupt the integrity or performance of the Platform
• Use the Platform for unlawful, harmful, or fraudulent activities

6. Fees and Billing

At present, CheckDataNow is provided without charge as an early‑access / evaluation service. We may introduce paid plans or usage‑based pricing in the future. If we do so, we will present applicable fees and any additional billing terms (including renewal and cancellation) at the time of purchase, and those terms will form part of these Terms for paying customers.

Unless otherwise stated, fees (if any) will be exclusive of applicable taxes. You are responsible for paying any taxes associated with your use of the paid portions of the Platform as required by law.

7. Alerts, Accuracy, and No Guarantees

Anomaly detection involves statistical inference and may produce false positives or miss issues (false negatives). Alerts and insights are informational and intended to assist your team. You are responsible for validating alerts and deciding what operational or business actions to take.

8. Availability

We strive to provide reliable availability but do not guarantee uninterrupted or error‑free operation. The Platform is provided on an as‑is and as‑available basis.

9. Intellectual Property

We retain all rights, title, and interest in and to the Platform, including software, interfaces, and documentation, except for your data. These Terms do not grant you any ownership rights in the Platform. Subject to these Terms, you receive a limited, non‑exclusive, non‑transferable right to access and use the Platform for your internal business purposes.

10. Termination

You may stop using the Platform at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, posed a security risk, or engaged in abuse or fraud. Upon termination, your right to use the Platform will cease. We may retain certain records as required by law or for legitimate business purposes consistent with our Privacy Policy.

11. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Platform will be error‑free, uninterrupted, or that defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, Funnel Freaks will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from or related to your use of (or inability to use) the Platform, even if we have been advised of the possibility of such damages.

To the extent permitted by law, in no event will our total aggregate liability for all claims arising out of or related to the Platform exceed the greater of: (a) the amount you paid to use the Platform in the three (3) months preceding the event giving rise to the claim, or (b) INR 10,000 if no fees were paid.

13. Indemnification

You agree to indemnify and hold harmless Funnel Freaks from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Platform, your violation of these Terms, or your unauthorized connection to GA4 properties or other third‑party services.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts in Surat, Gujarat, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms, unless otherwise required by applicable law.
